“Talking Tom Gold Run Twitter Party” (the “Contest”) is organized by, Heather Lopez Enterprises, LLC, registered at 462 Woodbury Pines Circle, Orlando, FL 32828, United States, also known as Bloggin’ Mamas (“Heather Lopez”) and sponsored by Outfit7 Limited, registered at 5th Floor, 52-54 Gracechurch Street, EC3V 0EH London, United Kingdom, with business and billing address at Klimataria 11, 4607 Pissouri, Cyprus (“Outfit7”). GennComm, LLC, registered at 19528 Ventura Blvd., Suite 707, Tarzana California 91356, United States (“GennComm”) is the Public Relations agency of Record for Outfit7 in the United States, and is facilitating the Contest on Outfit7’s behalf. The Contest begins on 21st of July 2016 at 9:00 pm EST and ends on 21st of July 2016 10:30 pm EST (“Contest Entry Period”). Information on how to enter and prizes form part of these Terms and Conditions (“Terms and Conditions”).

By submitting an entry, each entrant agrees to the Terms and Conditions and warrants that his or her entry complies with all requirements set out in these Terms and Conditions.

Contest is open only to individuals who (i) are legal residents of the United States (ii) have reached the (a) age of majority in their jurisdiction of residence at the time of entry or (b) are of 13 years or above and have a written consent of a parent or legal guardian. Employees of GennComm, Outfit7, Heather Lopez and any party associated with the development or administration of the Contest, and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related are not eligible to participate in this Contest.

To enter into the Contest follow @TalkingTomCat and @BlogginMamas on Twitter and RSVP to the Contest by entering your information into the Mr. Linky widget, which is a widget that collects RSVPs. During the Contest Entry Period entrants have to tweet, using #TomGoldRun hashtag. The entrant may answer more than one question and can tweet the right answer more than once.

Among all entrants that will enter into the Contest, as defined above, and who correctly answer (tweet) to the question in connection with the Talking Tom and Friends apps, one (1) winner for each question will be randomly selected via Random.org, which is an online tool that provides random drawing of winners. In addition, one (1) winner will be randomly selected for RSVP’ing to the Contest in accordance with this Terms and Conditions. The selection of winners is final and binding.

Entrant gives consent to use any personal information he/she discloses while tweeting and is aware that by tweeting these information will be publicly disclosed.

The entry must not infringe, in any manner, any third party’s rights, title and interest in and to any and all intellectual property, including patents, copyrights, inventions, original works of authorship, developments, concepts, improvements, designs, discoveries, ideas, trademarks or trade secrets.

The entry cannot refer to any brand names other than those of Outfit7 and cannot be confusingly similar to any third party product names, brand names or trademarks.

The entry cannot contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

The entry cannot contain material that is inappropriate, obscene, indecent, tortuous, offensive, violent, hateful or defamatory, or that disparages GennComm and/or Outfit7 or contains any other content otherwise prohibited by or contrary to the applicable law.

Any entry that is determined by Heather Lopez or GennComm, in their sole discretion, at any time during the Contest, to violate this Terms and Conditions, or otherwise be unsuitable, offensive or in poor taste, may be rejected and the accompanying entrant disqualified.

GennComm shall be entitled to use the entry and the winner’s name and city and country for editorial, advertising, commercial and publicity purposes by GennComm, Outfit7 and/or others authorized by GennComm, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the entry. Entrant must supply full details as required, including contact details, and comply with all rules to be eligible for the prize.

Winners will be chosen during the Contest Entry Period and notified via a Mention on Twitter with a request to complete the following claim form: bit.ly/TTGRclaimform;. Form must be completed with a valid email address in order to be able to receive Contest Release Form. Winner will have forty – eight (48) hours to complete the claim form and an additional forty – eight (48) hours to send back their signed Contest Release Form or alternative winner will be selected among all other entries received during the Contest Entry Period. In case the winner will not claim the prize and send back signed Contest Release Form, in accordance with this Terms and Conditions, GennComm shall promptly delete any and all personal information received from that particular winner. We do not knowingly collect personal information from children under 13. If you become aware that your child has provided us with personal information without your consent please contact Twitter via https://support.twitter.com/forms/privacy and they will take steps to remove such information and terminate the child’s account.

Six (6) winners will be selected from the Contest by GennComm randomly via Random.org. The prizes are: one (1) iPad Air with preloaded Talking Tom and Friends apps (value $399.00), one (1) voucher for Talking Tom and Friends online store in the amount of $75.00 (value $75.00), three (3) vouchers for Talking Tom and Friends online store in the amount of $25.00 (value $25.00 each) and one (1) voucher for Talking Tom and Friends online store in the amount of $50.00 (value $50.00). Prizes are not exchangeable for cash. Vouchers are not valid on shipping and handling costs, meaning that the person exercising the voucher will need to cover the costs of shipping and handling even if the value on the voucher is high enough to cover this costs as well.

The winner shall inform Heather Lopez of their address and any additional details required by applicable laws. Income and other taxes, if any, are the sole responsibility of the winner. The Prize is not transferable. Except where prohibited: (i) the entry constitutes consent to use winner’s name, likeness, and entry for editorial, advertising, and publicity purposes, without further compensation; (ii) winner may be required to sign an affidavit of eligibility and copyright transfer/liability/publicity/permission release. If the winner is deemed to be a minor under the jurisdiction of his/her residence, the parent or legal guardian must execute the necessary affidavit and release. Affidavits and releases must be returned within forty – eight (48) hours of attempted notification or an alternate winner may be chosen. Failure to execute and deliver any required documents to GennComm by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY EMAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE POTENTIAL WINNER.

Each entrant releases and discharges GennComm, Outfit7, Heather Lopez and any other party associated with the development or administration of the Contest, their employees, agents or representatives or any of their parents, subsidiaries, sister companies, or affiliates from any and all liability in connection with the Contest, including without limitation, legal claims, costs, injuries, losses or damages, demand or actions of any kind. Entrant hereby agrees to hold GennComm, Outfit7 and any of its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waives any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any GennComm, Outfit7 site, or any other use authorized under these Terms and Conditions, of any entry.

Entrant acknowledges and agrees that GennComm, Outfit7 and Heather Lopez shall have no obligation to post, display or otherwise make publicly available any entries or information submitted by any entrant, and may, in its sole and unfettered discretion, remove, edit, modify or delete any entry. Each entrant understands and intends that any entry may be available for viewing, rating, review and comment on by the public, and understands that comments or ratings with which he/she disagrees or is unhappy about may be published or otherwise become associated with any entry.

Heather Lopez and GennComm reserve the right to cancel the Contest at any time, if deemed necessary in their opinion, and if circumstances arise outside of their control. GennComm and Heather Lopez reserve the right to substitute any prize with an alternative of an equivalent value or to otherwise change the Terms and Conditions of this Contest at any time, in accordance with applicable legislation in force.

By submitting any entry, each entrant hereby waives any privacy expectations that he might have with respect to any such entry. Any personal information received by Heather Lopez and GennComm in connection with this Contest will be handled in accordance with these terms and applicable data protection legislation. California law shall govern interpretation and enforcement of this Terms and Conditions in the Los Angeles Superior Court, regardless of conflicts of laws principles. If a dispute arises the prevailing party shall be entitled to recover from the other party its costs and expenses, including reasonable attorney’s fees. Entrant agrees to and waives personal jurisdiction.
